5. Response to Valid Notices
Upon receipt of a valid DMCA notice, Key on Harmony may:

Take additional action as appropriate under applicable law.
We reserve the right to remove content at our discretion when potential infringement concerns arise.
6. Counter-Notification Procedure
If you believe that material removed or disabled as a result of a DMCA notice was removed in error or misidentification, you may submit a written counter-notification including:
Your physical or electronic signature;
Identification of the removed material and its prior location;
A statement under penalty of perjury that you have a good faith belief the material was removed due to mistake or misidentification;
Your name, address, telephone number, and email address;
A statement consenting to the jurisdiction of the federal court located in California and that you will accept service of process from the person who submitted the original DMCA notice.

7. Repeat Infringers
Key on Harmony reserves the right to suspend, restrict, or terminate access for users or parties who repeatedly infringe intellectual property rights or violate this DMCA Policy.
8. Misrepresentation

that material was removed by mistake
may be subject to liability for damages, costs, and attorneys’ fees.
